Greene County district court, week ending March 20

In Greene County district court Michael James Wagoner, 43, of Jefferson was sentenced March 18 to five years in prison, with credit for time served, after changing his plea to guilty to a charge of domestic abuse assault- third or subsequent offense. The prison term is consecutive to a sentence entered in January in another Greene County case. Wagoner was fined $1,025 with a $153.75 surcharge. The court found him unable to pay restitution for his court appointed attorney’s fees. In a related case in magistrate court, Wagoner was sentenced to 70 days in jail on 10 counts (seven days on each count) of violation of a no contact order. That sentence is consecutive to the previous sentence. Court costs in that case were $447.20. A case in which he was charged with obstruction of emergency communication was dismissed. Jay Doliver Orsack, 59, of Churdan was sentenced to 30 days in jail after he pleaded guilty to a charge of assault- simple, amended from assault causing bodily injury or mental illness. The jail term is consecutive to sentenced in three other Greene County felony cases on charges of criminal conduct- influence enterprise, controlled substance violation, and criminal mischief- second offense. He was fined $105 with a $15.75 surcharge. Court costs were $216.40. (Sentencing: McCarville)

Cody Leonard Greiner, 34, of Colfax was sentenced to 10 days in jail, with credit for time served in a Polk County case, after he changed his plea to guilty to a charge of driving while license barred. He was fined $855 with a $128.25 surcharge; both were suspended. He must pay $400 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)

Derlin Oveniel Alvaren Martinez, 31, of Jefferson was sentenced to 30 days in jail, with credit for time served, after he changed his plea to guilty to one count of criminal mischief- fourth degree. He was fined $430 with a $64.50 surcharge. A second count of criminal mischief- fourth degree was amended to criminal mischief- fifth degree. On that count he was sentenced to seven days in jail, with credit for time served but consecutive to the previous jail term. He was fined $105 with a $15.75 surcharge. Damon David Joseph Zimpel, 35, of Scranton was sentenced to one year in jail, with credit for time served, after he pleaded guilty to a charge of operating while intoxicated- second offense. All but seven days was suspended and he was placed on probation to the Iowa Department of Correctional Services for two years. He may complete a 96-hour alcohol education program provided by Des Moines Area Community College in lieu of four days of the jail term. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense, and he must complete a drinking drivers course. Zimpel was sentenced to one year in jail, with credit for time served, on a related charge of child endangerment. All but seven days was suspended. He was fined $855 with a $128.25 surcharge. Darren Scott Lehrkamp, 33, of Scranton pleaded not guilty to charges of assault causing bodily injury or mental illness and false imprisonment. A trial was scheduled for Mary 12.

Information is available since the return of an arrest warrant that Kayla Leigh Lundgren, 36, of Fairmont, MN, is charged with forgery and theft- fourth degree. The case was initiated in February 2017 and the warrant was issued the next month. It was served March 16 of this year.
